Agreeing to these terms
These terms apply when you use the K&D Lafayette Masonry and Concrete website, call us, ask for an estimate or hire us for work. Using the site or booking a job with us means you agree to them, so please read them before you do.
If you don't agree with these terms, please don't use the site. You can always go back to our home page to find the information you need and decide from there.
The work we do
We're a masonry contractor in Lafayette, LA, and we also do concrete work. That includes foundation repair, brick and chimney repair, tuckpointing, pavers, retaining walls, stone veneer, outdoor kitchens and related jobs for homes in Lafayette and the cities around it. You can read more about our crew on our About page.
The service descriptions on this site are general. The exact scope of your job is what's written in your estimate or agreement, and any work outside that scope isn't included unless we both agree to it in writing.
When you hire us, you confirm that you own the property or have the owner's permission for the work, and that our crew can safely reach the work area. If your job needs a permit from your city or parish, your written agreement will say who applies for it.
Estimates and pricing
Our on-site estimates are free and obligation-free. An estimate is based on what we can see during the visit and on material costs at that time, and it stays good for the period written on it.
Masonry often hides problems behind the surface, so once a wall, chimney or slab is open we sometimes find damage that wasn't visible, such as a cracked footing or failed mortar deeper than it looked. When that happens, we stop, show you what we found and give you a written change in price before we do any extra work.
General information on this site about what affects cost is not a quote. Only a written estimate from us sets the price of your job.
Scheduling, weather and cancellation
We set a start date when you accept your estimate. Weather can move that date because mortar and concrete need the right conditions to set and cure, and if rain or wet ground pushes your job back, we'll tell you and set a new date as soon as we can.
You can cancel or reschedule by calling (337) 216-1882. Please tell us as early as you can, because if we've already ordered special materials or started work, you'll owe for those materials and for the work done up to that point.
We may reschedule or cancel a job if conditions on site make the work unsafe. If we cancel, we'll refund any deposit for work we haven't done.
Payment
Your written estimate or agreement sets out any deposit and when each payment is due. Unless it says otherwise, the balance is due when the work is complete.
If a payment is late, we may pause work until it's paid, and you'll be responsible for reasonable costs of collecting what's owed as Louisiana law allows. Nothing in these terms gives up any right we have under state law to secure payment for work done on a property.
Our guarantee and what it doesn't cover
Our work is backed by our satisfaction guarantee, so if something we built or repaired isn't right, call us and we'll come out and look at it. Any specific written warranty for your job is the one in your agreement.
We can't guarantee against things outside our control, such as soil movement, the house settling, flooding, tree roots, storms, damage caused by others, or existing masonry we didn't work on. Brick, stone and concrete are natural materials, so small differences in color and texture, and fine hairline cracks as concrete cures, are normal and aren't defects.
Apart from your written agreement and the guarantee above, this website and its information are provided as is, without other warranties, to the extent the law allows.
Limits on our liability
We're fully licensed and insured, and we stand behind the work we do. To the extent Louisiana law allows, our liability for any claim about a job is limited to the amount you paid us for that job, and we aren't liable for indirect losses such as lost rent or lost use of the property.
We aren't responsible for decisions made only on the general information on this site, because every house and every job is different. These limits don't apply to our own gross negligence, intentional misconduct or anything else the law doesn't allow us to limit.
Settling a disagreement
If you're unhappy with something, call us first, because most problems get sorted out faster on site than on paper. We'll come out, look at the issue with you and tell you what we'll do about it.
If we can't settle it within 30 days of you telling us about it, either of us may ask for mediation or take the matter to court.
Which law applies
These terms and any work we do are governed by the laws of the State of Louisiana. Any court case about them will be heard in the courts of Lafayette Parish, Louisiana.
Changes to these terms
We may update these terms from time to time by posting the new version on this page. The version in place when you accept your estimate or sign your agreement is the one that applies to that job.
